【國務院背書未定論】

美國國務院9月16日堅稱同意,美國在台協會(AIT)前主席卜睿哲和前副處長王曉岷9月14日發表的評論,認為所有二戰時期的文件、尚未確定台灣的最終政治地位。然而,有一位中國官員卻錯誤地,將二戰時期的文件描述為台灣已割讓給中國。

【二七五八只談一中】

1971年10月25日,聯合國大會第26屆會議通過了第2758號決議,承認中華人民共和國為中國在聯合國的唯一合法代表,並立即將蔣介石代表驅逐出聯合國及其所有相關組織。此後,中華人民共和國聲稱台灣是中國不可分割的一部分,但中華人民共和國卻從未統治過台灣一天。

【金山和約總結論述】

第80屆聯合國大會於2025年9月9日開幕,誰在國際社會代表台灣的問題仍懸而未決。中華民國外交部長林佳龍於8月16日表示,二戰後,具有國際法約束力的1951年《舊金山和約》取代了《開羅宣言》和《波茨坦公告》。其實它並非取代,而是總結;主旨要限制日本戰後領土範圍,並正式承認朝鮮獨立。

【開羅宣言意向表達】

眾所周知,《開羅宣言》只是二戰三大同盟國——羅斯福總統、邱吉爾首相和蔣介石委員長的意向承諾,他們致力打贏這場戰爭、來遏制和懲罰日本的侵略,他們不為自己謀取任何利益,也無意擴張領土。其目的是要剝奪、日本自1914年第一次世界大戰爆發以來,在太平洋上奪取或佔領的所有島嶼。

【蔣介石爭台澎歸還】

然而,蔣介石卻要求將台灣和澎湖列島歸還中國。這不僅徹底違背了三國之間關於禁止領土擴張的共識,也扭曲了台灣和澎湖列島並非被日本竊取的歷史事實。

【馬關條約永久割讓】

1895年4月17日,清政府依據《馬關條約》正式將台灣和澎湖列島及其全部主權永久割讓給日本。這些島嶼並非像1910年日本透過暴力和貪婪奪取的朝鮮那樣的領土,三國一致決定,朝鮮最終應該獲得自由和獨立。

【二戰文獻地位未決】

9月3日,中華人民共和國舉行盛大閱兵,展現中國戰時雄心,並引用《開羅宣言》、《波茨坦公告》和《舊金山和約》等二戰時期文件,宣稱台灣已被割讓給中國。美國在台協會AIT處長谷立言、前AIT主席卜睿哲、和前AIT副處長王曉岷均表示,美國不認為台灣的政治地位,已由二戰後任何文件裁決,華府期只待台灣議題能夠獲得和平解決。

【台灣人民享有國籍】

困境在於,台灣執政當局堅稱其代表台灣的是中華民國政府,而中華人民共和國則援引聯合國第2758號決議,宣稱自己是中華民國的繼承者。然而,台灣仍然被排除在聯合國之外。那麼,今天誰在國際社會代表台灣呢?根據《世界人權宣言》第15條,「人人有權享有國籍」。那麼台灣2,300萬民眾的國籍究竟是什麼?當然,中華人民共和國無權代表我們,但世界上是否存在一個能夠合法代表我們的台灣政府?

【日本尚未移交主權】

2007年,前總統陳水扁用中華民國總統府的信紙,申請台灣加入聯合國;他以為「中華民國」就是「台灣」。但事實並非如此,他的申請立即遭到聯合國秘書長潘基文的拒絕。因為目前台灣還沒有一個,獲得國際承認的政府。因此,我們現在必須建立一個,由台灣人民選舉產生的正式台灣政府。只有這樣,我們才能獲得全球認可,並最終通過加入聯合國的考驗。國家主權只能透過和約、合法地從一個政府轉移到另一個政府。正如今天大家所周知,日本尚未將台灣主權合法轉給,任何國家的政府。

On 16 September 2025, the U.S. State Department insisted that it agreed with comments made on September 14 by former American Institute in Taiwan (AIT) Chairman Richard Bush and former Deputy Director Robert Wang, stating that all World War II-era documents do not yet determine Taiwan's final political status. However, a Chinese official erroneously described these WWII-era documents as indicating that Taiwan had been ceded to China.

[UN R2758: One China PRC]

On 25 October 1971, the 26th session of the United Nations General Assembly adopted Resolution 2758, recognizing the People's Republic of China as the only legitimate representative of China to the United Nations and immediately expelling the representative of Chiang Kai-shek(蔣介石) from the United Nations and in all the organizations related to it. Since then, the PRC has claimed Taiwan is an inalienable part of China, but the PRC has never ruled over Taiwan for a single day.

[SFPT concluded discussions]

The 80th Session of the UN Assembly opened on 9 September 2025, and the question of who will represent Taiwan in the international community remains unsolved. The ROC Minister of Foreign Affair Lin Chia-lung (林佳龍) said on August 16 that after WWII, the 1951 San Francisco Peace Treaty — binding under international law — superseded the Cairo Declaration and the Potsdam Proclamation. It wasn't a replacement, but rather a conclusion; it limited Japan's postwar territorial scope and granted formal independence to Korea.

[Cairo Declaration Will of Intent]

As we all know, the Cairo Declaration is only a will of intent for the Three Great Allies—President Roosevelt, Prime Minister Churchill, and Generalissimo Chiang Kai-shek—committed to fighting this war to restrain and punish the aggression of Japan. They covert no gain for themselves and have no thought of territorial expansion. It is their purpose that Japan shall be stripped of all the islands in the Pacific which she has seized or occupied since the beginning of WWI in 1914.

However, Chiang Kai-shek demanded Formosa and the Pescadores be returned to China. It not only completely violated the consensus of the Big Three prohibiting territorial expansion but also distorted the historical fact that Formosa and the Pescadores were not stolen by Japan.

[Shimonoseki Treaty Cession]

Taiwan and Penghu were officially ceded with the whole sovereignty by the Qing China to Japan in perpetuity under the Shimonoseki Treaty on 17 April 1895. They were not the territories like Korea taken by violence and greed of Japan in 1910, and the three great powers unanimously agreed and decided that in due course Korea should become free and independent.

[WWII-era Documents Status Undecided]

On September 3, the People's Republic of China held a grand military parade, showcasing China's wartime ambitions. It cited World War II-era documents such as the Cairo Declaration, the Potsdam Proclamation, and the San Francisco Peace Treaty, declaring that Taiwan had been ceded to China. American Institute in Taiwan (AIT) Director Raymond Greene, former AIT Chair Richard Bush, and former AIT Deputy Director Robert Wang all stated that the United States does not believe that Taiwan's political status is determined by any post-World War II document, and Washington expects that the Taiwan issue can be resolved peacefully.

[What’s Taiwanese Nationality?]

The dilemma is the governing authorities on Taiwan insist that they are the government of ROC representing Taiwan, while the People's Republic of China, citing UN Resolution 2758, claims to be the successor to the ROC. However, Taiwan remains excluded from the UN. So, who represents Taiwan in the international community today? According to Article 15 of the Universal Declaration of Human Rights, "Everyone has the right to a nationality." What, then, is the nationality of Taiwan's 23 million people? Of course, the PRC has no right to represent us, but is there a Taiwanese government in the world that can legitimately represent us?

[Japan Hasn’t Yet Transferred Sovereignty]

In 2007, former President Chen Shui-bian(陳水扁)used stationery from the ROC presidential office to apply Taiwan’s UN membership; he assumed ROC aka Taiwan. But this is not the case, he was rejected by UN Secretary-General Ban Ki-moon right away. Taiwan currently lacks an internationally recognized government. Therefore, we must now establish a formal Taiwanese government elected by the Taiwanese people. Only then can we gain global recognition and ultimately pass the test of UN membership. National sovereignty can only be legally transferred from one government to another through a peace treaty. As is well known today, Japan has not legally transferred Taiwan's sovereignty to any government.
