RE：Dec. 7（Fri.） Mass Protest Sit-In in front of AIT, Taipei

主旨：第三次於美國在台協會前的和平靜坐與嚴重抗議，要求美國國務院不要模糊對待台灣人，要搞清楚，因為：「我們是台灣人，不是中國人」。

Description: Our third Mass Protest Sit-in in front of the American Institute in Taiwan’s Taipei office will call for the US government to end its strategic ambiguity over Taiwan’s status, and to fully recognize that “We are Taiwanese, not Chinese.”

時間：二零零七年十二月七日（星期五）上午十時起
Time: Dec. 7, 2007 (Friday) beginning at 10:00 am

地點：台北市信義路三段140號至150號前（AIT前）
Location: No. 140 to 150 Shin Yi Road, Sec. 3, Taipei (entrance to AIT)

新聞內容：

（一）甲午戰爭後，一八九五年大清割讓台灣予日本，台灣成為日本國土。一九四一年美國與日本爆發太平洋戰爭，一九四五年八月十五日日本戰敗投降，台灣屬日本領土，當然也屬戰敗國。蔣介石接受「征服者」美國指揮，中華民國以次要佔領權來台代盟軍接受日本投降，佔領台灣。

After the Sino-Japanese War, the Qing Dynasty ceded Taiwan to Japan, therefore making Taiwan “Japanese territory.” The US war against Japan began in Dec. 1941, and the Japanese announced the acceptance of an unconditional surrender on Aug. 15, 1945. Chiang Kai-shek accepted the directions of the “conqueror” (the USA) and came to Taiwan to accept the surrender of Japanese troops, and undertake the military occupation of Taiwan.

（二）ㄧ九四九年十月ㄧ日，中國共產黨在北京武裝政變成功。一九四五年九月二日，因為美國麥帥發布「一般命令第一號」而來台灣的蔣介石集團，成為武裝政治難民，是國際上所稱「流亡政權」或「流亡政府」。

On Oct. 1, 1949, the CCP conducted a successful coup d’etat in Beijing and established the PRC. The government officers and military personnel under Chiang Kai-shek who had come to Taiwan based on the specifications of General MacArthur’s General Order No. 1 (Sept. 2, 1945) then became “armed political refugees,” which under international law amounted to a “government in exile.”

（三）ㄧ九七二年二月二十八日，美國與中國發佈「上海公報」，一九七九年一月ㄧ日，美中發表「建交公報」，一九八二年八月十七日，美中再度發布「八一七公報」。三個公報只提出中國人單方面看法：「台灣自古以來是其一部分」，事實上，我們台灣人的看法是：「台灣不是中國ㄧ部份」

On Feb. 28, 1972, the Shanghai Communique was promulgated. On Jan. 1, 1979, formal diplomatic relations with the PRC were established, and the second communiqué was issued. On Aug. 17, 1982, the 817 Communique was promulgated. In these communiqués, only the view of the PRC was stated, to the effect that Taiwan has been Chinese territory since antiquity ….. But the viewpoint of the Taiwanese people is that “Taiwan is not a part of China.”

（四）美國國務院向國際宣稱：「台灣不是國家。中華民國不是國家。台灣不是中華人民共和國一部分。」台灣人要請教美國政府：「台灣到底是什麼？」

In 2007, the US Executive Branch has stated that “Taiwan is not a state. The ROC is not a state. Taiwan is not part of the PRC.” At this point, the Taiwanese people sincerely want to ask the US government: “Well then, what is Taiwan?”

（五）台灣是臺灣人的土地，台灣是台灣人的一切，台灣是台灣人的將來，我們台灣人要強烈告訴國際社會：「我們是台灣人，不是中國人」。

The land in Taiwan belongs to the Taiwanese people, and Taiwan is “everything” to them, including their past, present, and future. At this time, it is necessary to proclaim to the world community: “We are Taiwanese, not Chinese.”

Mass Protest Sit-In
in front of AIT, Taipei

我等於二零零五年九月二十日，根據舊金山和平條約與美國憲法，重新釐清美國與台灣關係，美國軍事政府事台灣的佔領國，至今還沒有結束佔領與管轄的官方聲明，台灣依戰爭法及美國最高法院判例，台灣是『美國戰後之海外暫時領土，歸第一類列島區之外國領土。』並於華盛頓郵報刊登「What are you doing?」，美國國務院以「No comment不予評論作回應」。

On Sept. 20, 2005, we placed an advertisement entitled "What are you doing?" in the Washington Post explaining our legal research results of the last several years. We have determined that Taiwan is a US overseas territory under the jurisdiction of the United States Military Government (USMG) and the US flag should be flying. This conclusion is based on the war powers of the US Constitution, the post-war San Francisco Peace Treaty, the Taiwan Relations Act, and other relevant legal documents. In response to our advertisement, the US State Department said: "No comment."

二零零六年三月二十九日，我等二二八位台灣人依法至美國在台協會（AIT）申請美國國民護照（非公民），這是依美國憲法與美國移民歸化署規定辦理，同時，呈送美國各項法律條文根據，共三十五頁（http://www.taiwankey.net/dc/applyp6.htm），要求轉呈美國國務院，作為批准之法理依據，直到今天二零零七年十月一日我等尚未得到美國國務院回覆。

On March 29, 2006, some 228 native Taiwanese went to the Taipei Office of the American Institute in Taiwan (AIT) to submit their applications for US national passports. These applications were submitted according to the procedures and qualifications outlined in the US Constitution and the Immigration and Naturalization Act.

二零零六年十月二十四日，因為美國國務院與美國在台協會（AIT），未曾答覆台灣人申請國民護照之結論，顯然已達美國憲法規定「殘忍對待國民」之法律規範，所以，我等依法向美國華盛頓特區聯邦法院提出訴訟【（Roger C.S. Lin v USA案號Civil Action No.06-1825（RMC）】，經受理在案。

Failing to receive any appropriate action or response from AIT or the US State Dept. in regard to these applications, and recognizing that our constitutional rights against "cruel and unusual punishment" by not having an internationally recognized nationality were being violated, several members of our group, led by Dr. Roger C. S. Lin, filed suit in the US District Court, Washington, D.C. on Oct. 24, 2006. This court case is proceeding at the present time.

台灣這塊土地是全體台灣人所擁有，誰都不能自台灣人手上奪走，台灣主體意識是台灣人賴以維生的靈魂，崇尚自由、民主、人權是台灣人追求的目標。美日太平洋戰中，美軍解放了台灣，依照美國憲法、海牙第四公約（1907年）和舊金山和平條約（1952年），美國軍事政府暫時握有台灣澎湖地區的管轄權，台灣國際地位已經明確。【台灣地位宣言】 www.taiwanadvice.com/declarrch.htm 公佈於二零零六年三月二十九日。

The land in Taiwan belongs to the Taiwanese people, and of course no one can run them off of this land or confiscate it without due compensation. In their search for freedom, democracy, and human rights, a strong sense of Taiwanese consciousness is important to the Taiwanese people. As we know, during WWII in the Pacific, US military troops liberated Taiwan. According to the war powers in the US Constitution, the Hague Convention IV of 1907, and the San Francisco Peace Treaty of 1952, the United States Military Government (USMG) temporarily holds the jurisdictional powers over Taiwan, and this is the truth of Taiwan's international legal status.

On March 29, 2006, the "Declaration of the Taiwan Status" www.taiwanadvice.com/declare.htm was promulgated.

On October 1, 2007, we held a second Mass Demonstration Sit-in in front of the Taipei office of AIT to push our demands.

近來，中國武力併吞台灣野心顯露無疑，我等為促請美國國務院與美國在台協會（AIT），早日依法發放美國國民護照，以免台灣人至今仍然沒有國籍，使用非法中華民國護照，而美國國務院與美國在台協會（AIT）亦可免訟累及瀆職叛國之訴。

In the recent months, the Chinese have continued to vociferously announce their threats to seize Taiwan. Hence, we call upon the US State Dept. and AIT to begin issuing of US national passports to Taiwanese persons at an early date, so that their current status of "statelessness" can be avoided, and the issuance of the illegitimate Republic of China passports can be stopped. Such actions by officials of the State Dept. and AIT can also confirm that they are being faithful to their pledges to protect and defend the US Constitution against all enemies, foreign and domestic.

我等建國黨、保護台灣大聯盟、農民黨、二二八關懷總會與台灣平民民主黨將共同於二零零七年十二月七日早上十點鐘依法申請，在台北市信義路三段美國在台協會隔壁舉行『和平靜坐與嚴重抗議活動』

In order to more effectively advance our goals, all of our support groups including the Taiwan Nation Party, Taiwan Defense Alliance, Farmers' Party, Taiwan Civil Democratic Party, etc. will all join together for a third Mass Protest Sit-in in front of the Taipei Office of AIT on Friday, December 7, 2007 at 10:00 am.
