「自由資訊法案」FOIA申請
Dear Sir or Madame:
敬啟者：
On behalf of Dr. Roger C.S. Lin, 2nd Floor, Number 212 Qing Nian 2nd Street, Ling Ya District, Gaoxiong City, Taiwan (the “Requestor”), and pursuant to the Freedom of Information Act (“FOIA”), 5 U.S.C. Section 552, and 22 C.F.R. Part 171, I am pleased to make this FOIA request.
本律師事務所代表居住於高雄市苓雅區青年二路212號2F之林志昇博士，提出「自由資訊法案」FOIA申請，相關法律依據是5 USC 552 以及 22 CFR 171 。
Attached hereto as Schedule A are the documents requested from the Department of State (“DOS”). In order to aid the DOS in understanding and complying with this FOIA request, certain Capitalized words used in Schedule A are defined in Schedule B.
隨函付上文件A，向美國國務院申請公開的文件。至於此文件所包含的一些專有名詞在文件B裡都有提供相關定義。
Dr. Lin asks for a fee waiver for this FOIA request. The information requested in this FOIA request is in the public interest and is not in the commercial interest of Dr. Lin. As made clear by the documents requested, such documents concern the operations and activities of the DOS. Dr. Lin has attempted to obtain the requested documents from all available sources available to him, both within and without Taiwan. Dr. Lin does not believe that the information requested is available in the public domain, and will not use the information for commercial purposes.
林博士要求美國國務院對此文件申請案免收取手續費。理由如下：此申請案所要求的資料是涉及公共利益，並非林博士要運用，作為商業上的用途。而且綜觀所有要求公開的資料文件，都是與美國國務院的運作和管轄範圍有關。林博士曾經試著在台灣境內與境外尋找相關資料文件，而依據他的判斷，一般研究機構的圖書館或其他公共場所並無此相關資料。林博士也不打算運用這個文件資料作為商業上的用處。
Dr. Roger C. S. Lin was born in Taiwan in 1950. He has a Ph. D. in international law from Meijo University, Nagoya, Japan. He is Chairman of the Taiwan Civil Democratic Party, spokesperson for the Taiwan Nation Party, and has been researching the international legal status of Taiwan for many years, in order that the civil rights of the Taiwanese people may be better protected in the world community. Dr. Lin's research covers all aspects of U.S. constitutional law and international law, including the laws of war recognized by the United States. Notably, on October 25, 2004, (former) Secretary of State Powell said: "Taiwan is not independent, it does not enjoy sovereignty as a nation." Again, on August 30, 2007, Mr. Dennis Wilder, National Security Council Senior Director for Asian Affairs, said: "Taiwan, or the Republic of China, is not at this point a state in the international community. The position of the United States government is that the ROC -- Republic of China -- is an issue undecided, and it has been left undecided, as you know, for many, many years."
林志昇博士於一九五零年出生在台灣。他在Meijo University, Nagoya, Japan獲得國際法論文博士。他是台灣平民民主黨的黨主席兼建國黨的發言人，也一直努力於研究台灣國際地位多年，目的是為了台灣人民的人權能受到國際社會更完善的保護。林博士的研究範圍，涵蓋美國憲法與國際法各方面領域，也包含美國所承認的國際戰爭法範圍。值得一提的是，二零零四年十月二十五日美國國務卿鮑爾曾經說過：「台灣不獨立，也不享有國家的主權。」再者，二零零七年八月三十日美國國家安全委員會亞洲事務主任Wilder先生說：「台灣和中華民國都不是主權獨立的國家。美國政府的立場是：中華民國為一個未確定的議題，而且這個未確定的身分已經延續很多年。」
Yet, despite these announcements by important U.S. Executive Branch officials, Dr. Lin is extremely troubled by the fact that the ROC continues to exercise full administrative authority over Taiwan and the Taiwanese people. This administrative authority includes the issuance of identification documents (including passports and ID cards) to native Taiwanese people that identify these people as "ROC citizens." Dr. Lin believes that such a citizenship classification is incorrect under international law and U.S. constitutional law, and hence is desirous of uncovering all relevant U.S. government documentation references pertaining to this subject. The documentation and information requested in this FOIA request will be used in all relevant academic, political, and other related venues where the topics of the civil rights of the Taiwanese people are being discussed—and NOT for commercial purposes.
雖然美國行政部門的高官有如此的表示，但是林博士對於中華民國，現在還能繼續執行完整的台灣與台灣人民管轄權，感到相當地憂慮。中華民國的管轄權包含核發身分證明文件給台灣人民，繼續違法認定這些台灣人民是「中華民國公民」。林博士認為如此的公民認定，在國際法與美國憲法體系裏頭均是錯誤的，因此有高度興趣尋求所有美國政府相關文件與資料。這些相關文件與資料將會使用於相關學術、政治與其他探討台灣人民人權的場所，而並非作為商業用途。
In the unlikely event that a fee waiver cannot be to granted, Dr. Lin provides his assurance that fees up to a limit of US$2,500.00 will paid to DOS for this FOIA request.
若是出乎林博士的意料之外而美國國務院不得免收取相關費用，林博士已經準備美金US$2,500 給國務院負擔相關費用之需要。
This FOIA request should not be considered or interpreted as a Privacy Act Request.
此「自由資訊法案」FOIA申請不應視為隱私權法案之申請文件。

Document Request No. 1: Any and all documents, including any ratified treaties, that have modified or revoked any provisions of the SFPT.
文件要求第一號：任何包含參議院通過之條約、與其他已經修改或更正過「舊金山和約」的文件。
Document Request No. 2: All drafts of the SFPT.

Document Request No. 3: All documents authorizing General Douglas MacArthur to execute General Order No. 1.

Document Request No. 8: All documents interpreting and/or defining the phrase “principal occupying Power” as used in the SFPT, including all documents describing why the United States was defined in the SFPT as the “principal occupying Power” of Formosa and Pescadores (e.g., because the United States carried out all military attacks against (Japanese) Taiwan during the period December 1941 to the Fall of 1945, and, thus, was the “conqueror” of Taiwan).

Document Request No. 27: All documents containing or concerning the United States’ declaration or statement that the post-Japanese surrender occupation of Taiwan has ended.

文件要求第三十六號：所有文件，有關美國國務院如何認定，中華民國外交部經位於美國十三中華民國駐外代表處是核發護照給出生、居住、就讀、工作或旅行於美國五十州內，與主要列島區內，台灣人民之權責機關的文件。
